Terms of Service — Apex Grow Hydroponics

These Terms of Service govern your use of the Apex Grow Hydroponics website and the purchase of products through our online store. By placing an order, you agree to these terms in full.
1. About Us
Apex Grow Hydroponics is an online hydroponic retail store based in Victoria, Australia. For enquiries, contact us at hello@apexgrow.com.au.
2. No Change of Mind Policy
Apex Grow Hydroponics does not offer refunds, exchanges, or store credits if you change your mind, find the product cheaper elsewhere, or decide you no longer want or need the item. Please ensure you have selected the correct product before finalising your purchase.
3. Your Rights Under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
4. Damaged or Faulty Items
Inspection: We strongly recommend inspecting all items within 24 hours of delivery, including checking the packaging and product condition.
Reporting: If an item is faulty, damaged, missing parts, or does not match the description, please contact us as soon as possible, preferably within 24 hours of receiving your order, at hello@apexgrow.com.au with your order number, clear photos of the issue, and photos of any damaged packaging.
Damage Reported After 24 Hours: If damage is not reported within 24 hours of delivery, this may affect our ability to verify that the damage occurred during delivery or handling, and may affect the remedy options available for delivery-related damage. However, this does not limit or exclude any rights you may have under the Australian Consumer Law.
Remedy: We will assess your claim promptly. If the product is found to be faulty, damaged upon supply, or otherwise fails to meet a consumer guarantee, we will provide a repair, replacement, or refund in accordance with your rights under the Australian Consumer Law.
Return Shipping: Unless the item is confirmed to be faulty, damaged upon supply, or otherwise covered by the Australian Consumer Law, customers are responsible for arranging and paying all return shipping costs. If Apex Grow Hydroponics arranges return shipping for an approved non-faulty return, the cost of return shipping may be deducted from the refund amount. Original postage, delivery, and handling fees are non-refundable for non-faulty returns, unless otherwise required by law.
5. Limitations on Claims
You are not entitled to a remedy under this policy if:
- The damage was caused by misuse, carelessness, or incorrect installation after delivery
- The product has been modified or used in a way that violates the manufacturer's instructions
- A reasonable time has passed since purchase during which the damage could have been caused by your use of the product
6. Order Cancellations
Orders cancelled within 2 hours of placement will receive a full refund, provided the order has not yet been dispatched. Once an order has been dispatched, it cannot be cancelled. Please contact us immediately at hello@apexgrow.com.au if you need to cancel.
7. Pricing Errors
We make every effort to ensure product pricing is accurate. In the event of a pricing error, Apex Grow Hydroponics reserves the right to cancel the order and issue a full refund. We will notify you promptly if this occurs.
8. Limitation of Liability
To the maximum extent permitted by law, Apex Grow Hydroponics' total liability to you for any claim arising from your purchase is limited to the value of the order placed. We are not liable for any indirect, incidental, or consequential loss or damage.
9. Privacy
Your personal information is collected and handled in accordance with our Privacy Policy, available on our website. By placing an order, you consent to the collection and use of your information as described in that policy.
10. Responsible Use & Legal Compliance
Customer Responsibility: By purchasing from Apex Grow Hydroponics, you represent and warrant that you will only use our products for lawful purposes and in accordance with all applicable local, state, and federal laws of Australia.
No Liability for Misuse: Apex Grow Hydroponics expressly disclaims all liability for any illegal, unauthorised, or unintended use of our products. We do not promote, condone, or encourage the cultivation of any controlled substances or any other unlawful activity. Our products are sold solely for legitimate horticultural, agricultural, and hydroponic growing purposes.
Indemnity: You agree to indemnify and hold Apex Grow Hydroponics, its directors, employees, and agents harmless from any claims, legal actions, losses, fines, or damages arising from your use of any product in a manner that violates applicable law or these Terms of Service.
11. Safety & Liability Disclaimer
Important Safety Information
By purchasing equipment from Apex Grow Hydroponics, you acknowledge and agree to the following safety requirements:
Professional Installation: We strongly recommend that all electrical components, including grow lights, ballasts, and high-wattage pumps, be installed and inspected by a licensed Australian electrician. Incorrect installation can lead to electrical fires or fatal electric shocks.
Water & Electricity Risk: Hydroponic systems involve the close proximity of water and electricity. Always use a Residual Current Device (RCD) or safety switch and ensure all electrical connections are kept high, dry, and away from potential leaks or spray.
No Unattended Operation: High-intensity lighting and water pumps should be monitored regularly. Do not leave equipment running in unoccupied premises for extended periods without professional safety fail-safes in place.
Manufacturer Instructions: Always read and strictly follow the manufacturer's manual. Any modification to the product, including cutting plugs or rewiring, immediately voids all warranties and releases Apex Grow Hydroponics from all liability.
Assumption of Risk: The user assumes all risk and responsibility for the setup and operation of this equipment. Apex Grow Hydroponics is not liable for any property damage, personal injury, or financial loss resulting from the misuse or failure of these products, to the maximum extent permitted by Australian law.
12. Governing Law
These Terms of Service are governed by the laws of Victoria, Australia. Any disputes arising from these terms or your use of our store will be subject to the exclusive jurisdiction of the courts of Victoria.
13. Changes to These Terms
Apex Grow Hydroponics reserves the right to update these Terms of Service at any time. Changes take effect immediately upon publication to our website. Continued use of our store constitutes acceptance of the updated terms.
